By accessing this website and /or by placing an order, you accept these terms and conditions (the “Terms and Conditions”) in full and the documents referred to within them. If you do not agree to be bound by these Terms and Conditions, you must not use this website.

The Diar il-Bniet Site is provided solely for your personal use. You may not use this website for any commercial, illegal or unauthorised purpose.

The following Terms & Conditions apply to the use of the entire Site and/ or all orders placed by ‘You’ (the customer or user of this website) with Mifsud Local Enterprise Ltd. (“Diar il-Bniet”, “we”, “us” or “our”), for all products displayed on this website.

Please do read these Terms and Conditions carefully as they contain important information about your order and use of this website.

Eligibility

To be eligible to purchase goods on this Site and to lawfully enter into and form contracts on this Site under Maltese law you must: (a) be 18 years of age or older; (b) register on the Site; and (c) be the holder of a valid Paypal account linked to a valid credit card.

Basis of Sale

Our website is set-up to guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

When you confirm and pay for your order, you offer to buy the Products at the prices indicated including any delivery charges that apply to your purchase.

After placing an order, you will receive an e-mail from us acknowledging that we have received your order.

If we are unable to supply you with a Product, for example because that Product is not actually in stock or no longer available or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order. If you have already paid for the Products, we will refund you the full amount as soon as possible.

Payment and Prices

The price of the Products and our delivery charges will be as quoted on the site at the time you submit your order and will be advised during the check-out process before you confirm your order. We take all reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system.

The price of a Product is VAT inclusive (where applicable) at the applicable current rate chargeable in Malta for the time being.

Product prices and delivery charges are liable to change at any time, but changes will not affect orders already placed.

Payment can be made using Master Card, Visa, Maestro and PayPal. Payment for the Products and all applicable delivery charges is in advance.

It is always possible that, despite our reasonable efforts, some of the Products on our site may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that:

  1. where the Product’s correct price is less than the price stated on our site, we will refund the difference when dispatching the Products to you. However, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price; and
  2. if the Product’s correct price is higher than the price stated on our site, we will contact you in writing by e-mail as soon as possible to inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.

Gift Wrapping

Additional gift message can also be specified in the shopping basket. If you require extra wrapping, then you need to contact our Artisanal on +356 2762 0727 paying for such gift wrapping charge directly.

Delivery & Returns

Delivery

Processing time usually takes 1-2 business days.  Delivery times are based on orders placed between Monday – Friday (excluding public holidays).

Christmas Orders

Christmas orders received by us on or before 18th December are guaranteed a pre-Christmas delivery. Orders after the 14th December, cannot be guaranteed a next day delivery service. Hampers ordered for Christmas will be will be delivered between 1st December till the 23rd December.

Orders costing €50 and over will be delivered free of charge. Discounts applied for orders exceeding €500

Local Customers (Malta)

Delivery is done via MaltaPost.

The delivery charges:

  • €6.50 Flat Delivery Charge applies.
  • Delivery Charge for Gozo and World-wide International Delivery charges need to be verified and confirmed with the management.

Items not received

If the goods dispatched by Malta Post are not delivered, we will be unable to refund you before we have allowed 30 days to pass from the date of dispatch.  If you still haven’t received your order after this time, please contact us and we can assist you.  Please note there is a time limit of 3 months from purchase after this no refund will be made.

Refund & Returns

If you decide to cancel an order after we have dispatched the product/s, you will be under a duty to return them to us, at your own risk. We will not pay for delivery of returned items.  All products should be returned within 30 days after the items have been delivered to you. In the time until they are returned, you must retain possession of the Products and take reasonable care of them.  You should return the Products to us unused (except to the extent necessary to examine them) and in the same condition in which you received them together with the original packaging and paperwork.

After you have cancelled your order and returned the products as specified above within the first 14 days from when you acquire physical possession of the products as per your legal rights, we will refund in full any sum debited by us.  We will notify you of your refund via email within a reasonable period of time.  Refunds of products purchased as gifts can only be given to the Paypal account holder of the person who placed the original order.  We endeavour to process the refund due to you as soon as possible and, in any case, within 30 days of you cancelling your order. Please be advised that you cannot return any unsealed products for health protection and / or hygiene reasons.

In case of returns of products after the first 14 days until the 30th day, we will either provide you with a credit note or a replacement of the product will be given.  Please contact Customer Services for more information on credit notes and replacement of products. Please be advised that you cannot return any unsealed products for health protection and / or hygiene reasons.

If any of the products purchased are damaged, incorrect or faulty when delivered to you, we may offer a refund or replacement of the product as appropriate or a credit note, in accordance with your legal rights.  If you believe a product is faulty, you should return the product to us in accordance with the returns procedure.  If you have any questions regarding returns, please contact Customer Service.

Returns can be made by visiting Diar il-Bniet Farmshop on presentation of a Diar il-Bniet invoice (provided on delivery of product/s) and as specified above.  In case of all returns, You can either exchange a product with a replacement or request to have a credit note. This without prejudice to your legal rights.

Cancel your order

Diar il-Bniet reserves the right to cancel any orders up to the point of delivery for products that have been listed at an incorrect price, rebate or refund, or contain incorrect information or typographical errors or are unavailable for any reason.  Dear il-Bniet has this right regardless of whether the order has been confirmed or your payment processed.  If your account has already been charged for the purchase and your order is cancelled, we will issue a credit to your account in the amount of the charge.

It is not possible to cancel your order online, in the meantime, you may contact Customer Service. If it is too late and your order is already on its way, you can still return it in accordance with our Returns Policy and Procedures. Please be advised that you cannot cancel an order of unsealed products for health protection and / or hygiene reasons.

Limited licence to use website

Unless otherwise stated, Diar il-Bniet and/or its licensors own the intellectual property rights in the website and material on the website including all text, graphics, logos, button icons, images, data compilations and software used in connection with the Site. The trademarks, logos and service marks displayed on the Site are the registered and unregistered marks of Diar il-Bniet.  All other trademarks not owned by Diar il-Bniet that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us.  Subject to the licence below, all these intellectual property rights are reserved.

We grant you a limited, revocable and non-exclusive license to access and make personal use of the Site. This limited licence does not include the right to:

  • Republish material from this website (including republication on another website);
  • Sell, rent or sub-license material from the website;
  • Show any material from the website in public;
  • Reproduce, duplicate, copy or otherwise exploit material on this website for a commercial purpose;
  • Edit or otherwise modify any material on the website; or
  • Redistribute material from this website.

Limitations of Liability

We do not accept liability for any direct, indirect, special or consequential loss or for any business losses, loss of revenue, income, profits or anticipated savings, loss of contacts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.  These limitations apply even if Diar il-Bniet has been expressly advised of the potential loss.

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit.

By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable.  If you do not think they are reasonable, you must not use this website.

Indemnity

You hereby indemnify Diar il-Bniet and undertake to keep Diar il-Bniet indemnified against any losses, damages, costs, liabilities and expenses (including without limitation to legal expenses and any amounts paid by Diar il-Bniet to a third party in settlement of a claim or dispute on the advice of Diar il-Bniet’s legal advisers) incurred or suffered by Diar il-Bniet arising out of any breach by you of any provision of these Terms and Conditions, or arising out of any claim that you have breached any provision of these Terms and Conditions.

Breaches of these Terms and Conditions

Without prejudice to Diar il-Bniet other rights under these Terms and Conditions, if you breach these terms and conditions in any way, Diar il-Bniet may take such action as Diar il-Bniet deems appropriate to deal with such breach.  If you default negligently or willfully in any of the obligations set out in these Terms and Conditions (including our Privacy Policy), you shall be liable for all the losses and damages that this may cause to Diar il-Bniet.

Your account details

You warrant that the personal information which you are required to provide when you register as a customer is true, accurate and current in all respects.  See our Privacy Policy regarding the treatment of your personal information.

You are responsible for maintaining the confidentiality of your account and password and for taking all reasonable measures to prevent unauthorised access to your account.  You agree to accept responsibility for all activities that occur under your account or password.  If you have reason to believe that your password has become known to third parties, or is likely to be used in any way that is unauthorised by you, you should contact us immediately.  If you forget your password, we will reset it upon you request and send it to the email address, which you specified upon registration.

Your account can be cancelled by contacting Customer Service.

We reserve the right to refuse service and/or terminate accounts, without prior notice, if you violated these Terms and Conditions, or if we decide, in our sole discretion, that it would be in Diar il-Bniet best interest to do so.
